RIGHT TO LIFE




Article 21 of our Constitution  gives  RIGHT TO LIFE  to every person  residing in India. It reads:
no person shall be deprived of his life or personal  liberty except according to procedure established by law.

 The hon. Supreme Court in its various judgements has given positive and very broad interpretation of this Article.  In actual practice The Indian State seems to be violating this article both at policy formulation and implementation level.  The non-functioning CCTV cameras at the blast site in Pune on 1,8, 2012 is the latest example. Earlier also there have been numerous incidents of CCTV cameras installed in government establishments failing the investigating agencies at the time of terrorist attack, accidents, road rage violence or crimes against women. The most blatant case of playing with the lives of our defence and security agencies is the supply of substandard bullet-poof jackets. At the time of 26/11 it cost precious lives of our police personnel. Whenever these omissions and commissions come to light due to man made calamity the police and other concerned authorities have explanations for non functional gadgets installed by government in public establishments. But the responsibility is never fixed. Why are these gadgets not maintained? If the installing agency was not equipped to maintain them what was the logic behind installing them? We are never told. It is the public money that is wasted  in  installing these nonfunctional gadgets and nobody is held responsible for this waste.  

Similar non-concern is shown towards the safety of children going to privately- run schools. Because the parents of these children are well off they spent huge amounts of money on their(children’s) education. They (the children) travel long distances in their school buses which are quite costly. While, money is extracted from hapless parents on one pretext or the other no concern have been shown towards the safety of these children. We read the news of a Xth standard boy dying because the windows of the school bus he was travelling were not properly protected. A little girl slips from the huge hole in the floor of school bus and gets crushed by the same bus she was travelling. Yet nobody is accountable. No body is punished. Government  uses public money to provide compensation. No explanations are given as to who is responsible for getting the Supreme Court directives regarding the safety of school buses implemented. Why are they not being implemented? Parents too, who are well placed,  leave no stone unturned to help their wards to be at top in the class or in the school do not seem to be worried about the safety of their children. Because we do not read news about parents joining hands and forcing the authorities to implement the hon. Courts directions regarding the safety of school buses. One does not knot whether many parents have time to find out what these directives are and why they were given by the court?
